I. General Terms and Conditions

§ 1 Basic Provisions

  1. These terms and conditions apply to contracts you conclude with us (Randa Weiser UG) via the website www.blissandbold.de, unless otherwise agreed. Any inclusion of your own terms and conditions that deviate from or contradict these terms is expressly rejected unless explicitly agreed otherwise.

  2. A "consumer" within the meaning of these terms is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business, or profession. A "business" refers to any natural or legal person or partnership with legal capacity that acts in the exercise of its trade, business, or profession when entering into a legal transaction.

§ 2 Conclusion of the Contract

  1. The subject of the contract is the sale of goods.

    Our offers on the website are non-binding and do not constitute a legally binding offer to conclude a contract.

  2. You can submit a binding purchase offer (order) via the online shopping cart system. The goods intended for purchase are placed in the "shopping cart." You can review and modify the contents of the shopping cart at any time via the corresponding button in the navigation bar. After proceeding to checkout and entering your personal data, payment, and shipping details, the order summary will display all order details for final review.

    Before submitting your order, you can verify and correct all details (or cancel the order using your browser's "back" function). By submitting the order via the corresponding button ("place order," "buy now," or similar), you make a binding offer to us.

  3. Acceptance of the offer (and thus the conclusion of the contract) occurs promptly after your order through confirmation in text form (e.g., email), confirming the processing or shipment of the goods ("order confirmation"). If you do not receive such confirmation, you are no longer bound by your order. Any payments already made will be refunded immediately.

  4. Order processing and transmission of all information required in connection with the contract will be automated via email. You must ensure that the email address you provide is correct and that you can receive emails (e.g., by checking your spam folder).

§ 3 Special Terms for Payment Methods

  1. Payment via Klarna
    In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer the following payment options, with payments made to Klarna:

    Use of Klarna’s "invoice" and "installment purchase" options requires a positive credit check. For this purpose, we transmit your data to Klarna for address and credit verification. Please understand that we can only offer payment methods based on Klarna's credit check results.

§ 4 Right of Retention and Retention of Title

  1. You may only exercise a right of retention for claims arising from the same contractual relationship.
  2. The goods remain our property until full payment of the purchase price.

§ 5 Warranty

  1. Statutory defect liability rights apply.
  2. As a consumer, you are requested to check the goods upon delivery for completeness, obvious defects, and transport damage. Please notify us and the carrier of any complaints as soon as possible. Failure to do so will not affect your statutory warranty rights.

§ 6 Governing Law, Place of Performance, Jurisdiction

  1. German law applies. For consumers, this choice of law only applies insofar as it does not deprive them of the protection afforded by mandatory provisions of the law in the consumer's habitual residence.
  2. The place of performance and jurisdiction for all obligations and disputes is our registered office, provided the customer is not a consumer.
  3. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

2. Contract Formation

The technical steps for contract formation, the conclusion of the contract, and correction options are set out in § 2 of our Terms and Conditions.

3. Contract Language and Storage of Contract Text

  1. The contract language is German.
  2. The full text of the contract is not stored by us. You can print or save the contract data using your browser before submitting your order. Following your order, you will receive the legally required information for distance selling contracts and the terms and conditions via email.

4. Prices and Payment Terms

  1. All prices include taxes and any applicable shipping costs.
  2. Payment methods are displayed in the respective offers on our website.

5. Delivery Terms

  1. Delivery conditions, timeframes, and any restrictions are outlined in the respective offer or a designated section of our website.
  2. For consumers, the risk of accidental loss or deterioration of the goods during shipment passes to you only upon receipt of the goods.

6. Statutory Warranty Rights

Warranty rights are governed by § 5 of our Terms and Conditions.
